In this section, POMPEU informs you of the Conditions of Sale (hereinafter, Conditions) of the products purchased through our website https://www.pompeu.es/ as well as in person at one of our physical stores.

We invite you to read these Conditions in order to have full knowledge when buying with us. For any questions you may have, please contact [email protected] before placing an order.

The use of our web page implies the knowledge and acceptance of the present Conditions of Sale, as well as of the Legal Notice and Conditions of Use, the Privacy Policy and the Cookies Policy on the part of every user.

The products offered on our website correspond to designer clothing for men and women. The advertised products are accompanied by the following information:

- Name of the product.

- Image of the product.

- Product designer.

- Available sizes and colors.

- Sale price.

POMPEU tries to ensure that all the information contained in its website is complete, truthful and correct. If there is an error in any information, we will proceed to its rectification.

 

  1. Availability of the service

The items offered through this website are only available for shipment within the European Union.

 

  1. How to place an order.

As you browse and observe the different products we offer, you can select them. When you select one, a window will appear on the upper right side of the screen where you can process the order or view/edit it in the cart. You can continue to add products to the cart until you have finished making your selection.

At any time, you can delete the selected products by clicking on the trash can icon that appears in the aforementioned window. Likewise, you can add any discount you enjoy or have the opportunity to use, indicating it in the corresponding box when viewing/editing the order.

When you click on "Process Order" a series of boxes will appear for you to fill in, with the necessary data to formalize the order. Of these boxes, some have an asterisk (*) which indicates that it is a mandatory field to fill in. Those that do not appear with this asterisk can be filled in at the customer's discretion.

Once you have chosen the method of payment and the shipping method, your order will be formalized, and we will send you a message via e-mail confirming the order. We will inform you by the same way when the selected product or products are sent to the indicated address.

If you detect an error in your order after the completion of the payment process, you should immediately contact our customer service, [email protected],  to correct the error.

You can place the order from your registered customer account, or without registering, in this mode, you will be asked only the essential data to process your order. Once the purchase process is completed, you will be offered the possibility to register as a user or continue as an unregistered user.

 

  1. Availability of the products

In our web site appear the products that are available before you make a purchase. In case of difficulties or unavailability on our part, we will proceed to reimburse the amounts you have paid.

 

  1. Prices and payment methods.

The prices of the website are expressed in euros (€) and include Value Added Tax (VAT). These prices may change at any time, but this will not affect the products that have received an Order Confirmation.

 

The authorized means of payment are through PayPal, credit card or bank transfer (the details are indicated in the purchase process). In case you go to a physical store, you can pay with cash up to the amount of 1,000 euros.

To use PayPal, you must have a PayPal user account prior to payment. Once you have chosen this system, you will be redirected to the PayPal website where the payment will be completed and you will be shown the amounts to be paid with the inclusion of all taxes or fees applicable to the transaction. PayPal will send you a receipt of the transaction to your email account.

The payment with credit or debit card is made from PayPal without the need of a PayPal user account. The requested data (card number, expiration date and CVV) are collected and stored from PayPal, POMPEU does not have access to your credit card data.   1. Delivery Process.

Our orders are shipped free of charge by UPS, DHL and NACEX, three courier and parcel companies throughout the European Union. We do not ship outside this geographical area.

Unless unforeseen or extraordinary circumstances occur (summer sales, black friday, promotions or similar), we will send the order within 48h-72h in mainland Spain and 72h-96h for non mainland Spain and European Union.

For the purposes of these Conditions, it will be understood that the "delivery" or that the order has been "delivered" at the moment in which you or a third party indicated by you acquires the material possession of the products, which will be accredited by the signature of the reception of the order or the indication of the DNI in the agreed delivery address.

In the event that delivery cannot be made due to absence of the recipient, lack of cell phone, etc. and the package is returned to POMPEU, we will understand that you wish to withdraw from the contract and we will consider it terminated. Consequently, you will be refunded (same method of payment) or you will be given a voucher to redeem on your next order.

In the event that you have decided to reserve the product in store, after filling in the data indicated for this purpose, we will keep it and keep it in custody until you go to pick it up in person for a period of 48 hours, unless otherwise agreed.

 

  1. Liability for loss or damage

Pompeu shall be liable for any loss or damage to the order if such loss or damage is "foreseeable" under these Conditions. Otherwise, Pompeu shall not be liable for any loss or damage which is "foreseeable" by this definition.

We do not exclude or limit our liability to you for loss or damage where it is unlawful to do so. This includes any liability for death or personal injury caused by our failure, or the failure of our employees, agents or subcontractors, to use reasonable care; for fraud; or for defective Products, in accordance with Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for the Defence of Consumers and Users and other complementary laws.

Subject to the preceding paragraph, we shall not be liable for any loss or damage suffered by you as a result of your own failure to comply with these Terms, or as a result of any hardware or software failure, except in the case of failure of our Website.

 

  1. Returns and Withdrawals

For the purposes of these Conditions, a return shall be deemed to be generated by a defect, tare or receipt of an erroneous product, size change or withdrawal, otherwise NO returns are accepted.

In accordance with the provisions of the revised text of the General Law for the Defense of Consumers and Users approved by Royal Legislative Decree 1/2007 of November 16, specifically in Article 68 and following, as well as other complementary laws, the user, duly identified, has the right to withdraw from the contract agreed with POMPEU during a period of fourteen (14) calendar days from its conclusion, without stating the reason and without incurring any cost for such withdrawal.

For the purpose of calculating the fourteen (14) calendar days in which the user can freely withdraw, it is provided that the conclusion of the contract that binds the user and POMPEU shall be deemed produced since the user has received the order at the address provided by the user.

To exercise their right of withdrawal, the user, duly identified with your ID card, passport or any other document accepted by law for identification may use any of the following means:

Mr./Mrs._____________________________________, of legal age, with DNI/NIE/Passport_________________, in accordance with the provisions of Articles 68 and following of the Revised Text of the General Law for the Defense of Consumers and Users, approved by the Royal Legislative Decree 1/2007, of November 16, declares his willingness to WITHDRAW from the purchase and sale service, agreed with POMPEU, on _____ of ________ of 202_.

 

  1. By sending an email to the address [email protected] and in which the user expressly states his will to cancel, attaching a copy of his Identity Document front and back.
  2. Return of the order in due time and form at the address indicated by POMPEU.

 

POMPEU will inform you without delay of receipt of the withdrawal.

Once the period of 14 days from the communication of the right of withdrawal and not having received the products, it is understood that the user accepts the order in full, not being possible any claim.

In the event that the user exercises, in accordance with the terms above, his right of withdrawal, POMPEU will refund the amount by the same method of payment (PayPal, credit / debit card or bank transfer) used by you. In this sense, the reimbursement to the user will be withheld until POMPEU has received the returned order, and having checked the good condition of the products.

The products must be in perfect condition, not having been opened or used and retaining its original seal or packaging, in addition to the manuals, accessories or promotional gifts included in its case.

Once we receive your request, we will respond as soon as possible and, in any case, within one month. In the event that your request is not satisfactorily resolved, the user may go to the ordinary jurisdiction or process your claim through the Municipal Consumer Information Office of your municipality of residence or the Consumer Arbitration Board of your Autonomous Community.

  1. Applicable Law and Jurisdiction

These Terms and Conditions are subject to Spanish law. The parties submit, at its option, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the province of Lleida.
